Huber (Work Release)

Are you reporting for a Huber sentence?

You will need to have employment BEFORE you arrive for your sentence. Click on the following links for the Huber or Electronic Monitoring packets. Please fill out the packets and turn into the jail BEFORE your sentence so employment can be verified. If you arrive without, you will not be allowed to exercise your Huber privileges.

If seeking employment, please register with one of the above listed temp. agencies, prior to reporting for your sentence.

If you are self-employed, you will need to be able to show at least two years taxes and show liability/worker comp. insurance.

Things you will need the day you report:

  • $30 booking fee
  • Minimum 2 weeks board:
    • Huber ($20/day=$140/wk)
    • E.M. ($30/day=$210/wk)
  • Driver’s License and Social Security Card
  • All prescribed medications
  • Any work related uniforms/shoes
  • Valid auto insurance (if you are driving)

Huber Law 303.08 

Any person sentenced to a county jail for a crime, non-payment of a fine or forfeiture, or contempt of court, may be granted privilege of the leaving of jail during necessary and reasonable hours for the following purposes:

  • Working at employment.
  • Conducting any self-employed occupation.
  • Attendance at an assessment ordered by a court under 343.30(1q)c.
  • Attendance at a treatment program required by a driver safety plan under 343.30(1)c.
  • Attending court proceedings to which the person is a party or for which the person has been subpoenaed as a witness.
  • Attendance at an educational institution or medical treatment

By order of the court, the wages or salaries of the employed prisoners shall be disbursed by the sheriff for the following purposes, in the following order:

  • Necessary travel expenses to and from work.
  • Court-ordered support of the prisoner’s dependents, if any.
  • Other incidental expenses of the prisoner.
  • Payments, either in full or ratably, of the prisoner’s obligations acknowledged by him in writing or which have been reduced to judgment.
  • The board of the prisoner.
  • The balance, if any, to the prisoner upon his discharge.

The sheriff may refuse to permit the prisoner to exercise the prisoner’s privilege to leave the jail not to exceed 5 days for each breach of discipline or violation of Jail regulations.

Employment

Huber Law inmates confined to the Washington County Jail may be granted the privilege of leaving the Jail for the purpose of working at at a job, provided the following criteria is met.

Huber Law Employment of Inmates:

Huber Law inmates confined to the Washington County Jail may be granted the privilege of leaving the Jail during necessary and reasonable hours for the purpose of working at employment provided the following criteria is met. The employer must pay at least minimum wage and provide liability insurance to employ a Huber Law inmate on a full-time basis. The following information may be required to substantiate their legitimacy by providing information not limited to:

  • Federal Tax Identification Number
  • WI Department of Revenue Identification Number
  • Listing in telephone directory
  • Address
Further Requirements:

Necessary and reasonable hours shall be defined as a workday. Allowable hours out of the Jail will be determined by the Jail Supervisors based on verified work hours and travel time.

The work week shall be defined as a seven day period. An inmate may not work more than six days in a row for any given period of time, unless approved by the Jail Sergeant or Lieutenant.

Self employed Hubers will be required to provide 2 years of tax returns, contracts of jobs, and proof of liability insurance.

Self-employed Huber hours may be restricted to less than 12 hours a day.

Huber board per Wisconsin State Statutes 303.08(4) shall be charged at the current rate set by the Washington County Board per day of incarceration, regardless of number of days worked per week, while the inmate is gainfully employed or conducting the self-employed occupation of housekeeping or attending the needs of a person’s family or inmates granted release to pursue educational studies, other than required high school attendance.

Washington County Jail - Employment Restrictions

With every privilege comes responsibility and in a jail setting this means restrictions. To make sure Huber inmates are going to legitimate jobs, criteria needs to be met.


Huber Employment Restrictions

Inmates may only work one job at a time during their incarceration.

The Washington County Jail reserves the right to request prepayment of an inmate’s entire Huber board in cases where an employer has shown a previous history of non-compliance with Jail rules and requirements.

When, after reasonable requests for information from an employer has not been provided, the Washington County Jail may restrict the release of an inmate until such time as necessary information is received.

While incarcerated in the Washington County Jail under the Huber Law, you may only work in Washington County or adjacent counties.

Huber board is due every Friday. Failure to make payment will result in loss of release until monies have been paid.
You may not work for other inmates.

Inmates serving a Huber sentence at the Washington County Jail will be charged fees that are set by County Ordinance. These fees will be a per-day or per-week fee. You will be required to bring $250.00 when you report in and a weekly fee every Friday after that. You will be required to pay a weekly fee whether you work one day or six days. If you have a sentence of less than seven days, you will be required to pay the amount in full when you report in.

Huber Board will be collected for work, school, and childcare. Your board has to be turned into the Huber Accountant no later than 9:00PM on Friday. If the board is not in, you will be held in until Monday morning at 8:00AM when the Huber Accountant reports to work.

You may be asked to sign a wage assignment as a way to collect your Huber fees. Failure to comply with this may hinder your release for employment. You will be required to report with your two most recent pay stubs or verification of wages earned and turn in your original pay stub every payday if not on wage assignment.

You may be required to forfeit one weeks Huber board if you are held in for any violation of the Jail rules or a hold is placed on you by another agency. We do not accept personal checks or credit cards for Huber board or commissary.

Childcare

If you were granted childcare privileges on your commitment, it will be at the Jail’s discretion if you are allowed out. We will also determine the hours and number of days based on the information you provide us. Documents that you need to give us are:

A Birth Certificate indicating that you are the parent or court papers that you have legal custody.

The name of the other parent and a work schedule from their employer with the hours they work.

Childcare will only be allowed at your primary residence. No other adults are allowed in the home while you are there.

Transfer Requests

  • The Washington County Jail and the Sheriff have the final say in whether a person is allowed a transfer to another facility. The Judge in your case may only state an objection or non-objection to the serving of a jail sentence at another facility.

  • As a general rule, a person will not be considered for a transfer to another facility if they are not employed.

  • There is a fee charged at the current rate set forth by the jail to attempt a transfer to another facility, this fee is charged regardless of acceptance by the other facility.  The current fee is $50.

  • The facility receiving the transfer request has no obligation to accept a person as a transfer to their facility, nor do they have to state a reason for denial of the transfer.
